1. Agreement to Terms

By accessing or using The wAether App, related websites, APIs, or services (collectively the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or older depending on your jurisdiction) to use the Service. If you access the Service on behalf of an organization, you confirm that you have authority to bind that organization.

3. Accounts and Purchases

• Premium features unlock through a one-time Google Play billing transaction tied to your Google account.
• You are responsible for safeguarding your device, credentials, and in-app purchases.
• Refund requests are handled through Google Play policies unless required by local law.

4. Acceptable Use

You agree not to:

• Reverse engineer, dismantle, or derive source code from the Service.
• Harvest data without permission, overload our infrastructure, or interfere with normal operation.
• Use the Service for unlawful, harmful, or deceptive purposes.
• Misrepresent affiliation with The wAether App.

5. Intellectual Property

The Service, including code, design, and content, is owned by GooseyPrime and licensed to you for personal, non-commercial use. Third-party data providers retain ownership of their respective datasets.

6. Data Sources and Accuracy

Our data originates from NOAA, USGS, OpenWeather, and other public or licensed APIs. These sources may introduce latency, gaps, or inaccuracies. The Service is provided "as is" without warranties of completeness or fitness for a particular purpose.

7. Service Availability

We strive for reliable uptime using Vercel hosting and Azure Cosmos DB storage, but downtime, maintenance, or network issues can occur. We may suspend or limit access without liability.

8. Limitation of Liability

To the maximum extent permitted by law, The wAether App and its contributors shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.

9. Indemnification

You agree to indemnify and hold harmless The wAether App, its developers, and partners from any claims or damages arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend access to the Service at any time for conduct that violates these Terms. Upon termination, Sections 4 through 11 survive.

11. Changes to Terms

We may update these Terms. Material changes will be communicated via in-app notice or email. Continued use after the effective date constitutes acceptance.
